1. Acceptance of Terms

By accessing or using Doodle Mischief LLC's website and services at doodlemischief.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and customers.

2. Description of Service

Doodle Mischief provides a personalized children's coloring book service. Parents and guardians upload a photo of their child, provide personalization details, and receive a custom coloring book featuring an AI-generated character inspired by their child. Books are available as digital downloads (PDF) and as printed physical copies.

3. Eligibility & Parental Consent

You must be at least 18 years old to use this Service. By uploading a photo of a child, you represent and warrant that:

• You are the parent or legal guardian of the child depicted in the photo.
• You have the legal authority to consent to the collection and use of the child's image as described in our Privacy Policy.
• The child is under 14 years of age (our target age range for coloring books).

4. Orders, Payments & Refunds

• Payment: All payments are processed securely by Stripe. Prices are listed in USD and are subject to change.
• Digital orders: Digital PDF downloads are non-refundable once the book has been generated and made available for download, as the product is custom-created for you.
• Physical orders: Physical books may be refunded or replaced if they arrive damaged or defective. Contact us within 14 days of receipt.
• Generation failures: If our system fails to generate your book due to a technical error on our end, you will receive a full refund or we will regenerate your book at no additional charge.
• Character preview rejection: If you request changes to your character preview and we are unable to produce a satisfactory result within 3 attempts, you will receive a full refund.

5. Acceptable Use & Content Policy

You agree not to:

• Upload photos of individuals without their (or their parent's/guardian's) consent.
• Upload photos containing nudity, sexual content, violence, or other inappropriate material.
• Attempt to generate content that sexualizes, demeans, or harms children or any individual.
• Use our Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, scrape, or abuse our AI generation systems.
• Resell or redistribute our generated content without express written permission.

We reserve the right to refuse, cancel, or refund any order that violates these terms, at our sole discretion.

6. Intellectual Property

Your content: You retain ownership of the original photo you upload. By uploading it, you grant us a limited, non-exclusive license to use it solely for the purpose of generating your coloring book.

Generated content: Upon full payment, you receive a personal, non-commercial license to use the generated coloring book pages for your family's personal use, including printing and sharing within your household.

Our content: The Doodle Mischief brand, logo, website design, and underlying technology are owned by Doodle Mischief LLC and protected by intellectual property laws. You may not reproduce or use them without our written permission.

7. AI-Generated Content Disclaimer

Our coloring book pages are generated using artificial intelligence. While we strive for high-quality, age-appropriate results, AI-generated content may occasionally produce unexpected results. The generated character is an artistic interpretation inspired by your child's photo — it is not a photorealistic reproduction. We do not guarantee that the generated character will precisely resemble your child, and we offer the character preview approval process to ensure you are satisfied before payment.

8. Limitation of Liability

To the maximum extent permitted by law, Doodle Mischief LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid for the specific order giving rise to the claim.

9. Governing Law

These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Oregon.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
